2. Personal data

I only collect, process, and use your personal data with your consent or mandate or appointment for the purposes agreed with you or where another legal basis under the GDPR exists; always in compliance with applicable data protection and civil law provisions.

I collect only such personal data that is necessary for the performance and handling of my legal services or that you have voluntarily provided to me. Please note that under certain circumstances, I might abstain from accepting an engagement if you fail to provide or provide incomplete personal data which is necessary to execute and implement my legal services.

Personal data refers to any information relating to an identified or identifiable natural person, such as name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photographs, voice recordings, and biometric data such as fingerprints. It may also include sensitive data such as health data or data relating to criminal proceedings.

3. Your rights

As a data subject, you have – subject to legal provisions and attorney-client confidentiality – the right at any time to access your stored personal data, its origin, recipients, and the purpose of the data processing. You also have the right to rectification, data portability, objection, restriction of processing, and blocking or erasure of incorrect or unlawfully processed data (see Artt 12 et seq GDPR).

Please note that these rights complement each other; you can therefore request only to either rectify or complete or erase your data.

Please inform me of any changes to your personal data.

You have the right to revoke your consent to the use of your personal data at any time. Requests for access, erasure, rectification, objection, and/or data portability (where this does not involve disproportionate effort) can be directed to the contact details listed in section 1 of this privacy notice.

Despite my best efforts to guarantee the protection and integrity of your data, I cannot fully rule out that disagreements will arise on the nature of the use of your data. If you believe that your personal data is being processed by me in breach of data protection law or that your rights under the GDPR have been otherwise violated, you have the right to lodge a complaint with the Austrian Data Protection Authority as the competent supervisory authority. However, I hope that you will contact me first and we can address and dispel any doubts you may have.

4. Data security

I take appropriate organisational and technical measures to protect your personal data against unlawful, accidental, or unauthorised access, processing, loss, use, or manipulation.

Despite my efforts of ensuring an appropriately high standard of diligence requirements at all times, it cannot be ruled out that information you have provided via the internet will be accessed or used by other persons.

Please note that I can therefore not assume any liability whatsoever for the disclosure of information due to errors in the data transfer and/or unauthorised access by third parties not caused by me (eg hacking of e-mail accounts or telephone).

5. Use of data

Data made available to me will not be processed for purposes other than those covered by your consent or otherwise by a provision in accordance with the GDPR, except for the use for statistical purposes, provided that data made available was anonymised.

If you will disclose your (or your relatives’, co-workers’ or other third parties’) personal data and business or trade secrets, I generally assume that you are authorised to disclose this data.

6. Transfer of data to third parties

To fulfil your mandate, it may be necessary to transfer your data to third parties (eg counterparties, substitutes, insurers, service providers I engage) courts or authorities. Data will only be transferred in accordance with the GDPR, primarily to fulfil your mandate or based on your consent.

Categories of recipients may include:

• Cooperation partners (eg tax advisers, auditors, lawyers, payroll service providers);
• Involved parties (legal or contractual representatives, opponents, opponent’s counsel, official experts, court and authority representatives);
• Courts and administrative authorities;
• My professional organisations (Vienna Bar Association and Austrian Bar [ÖRAK]);
• Archiving services; testament registers;
• Authorities responsible for anti-money laundering and anti-terrorism compliance;
• Data processors (eg IT providers, cloud service providers, web hosting services, internet and email service providers, software/hardware support);
• Banks;
• Insurers (eg legal expenses insurers).

I also inform you that in the course of legal representation, case-related information about you may be obtained from third parties.

Some of the above recipients may be located outside your country or process personal data there. The level of data protection in other countries may not be exactly equal to the level of protection in Austria. I only transfer your personal data to countries for which the EU Commission has decided that they provide an adequate level of data protection, or I implement measures to ensure that all recipients provide an adequate level of data protection, such as by concluding Standard Contractual Clauses (Implementing Decision (EU) 2021/914 and/or 2021/915).

7. Website

The use of my website, including access to the information published thereon, is generally possible without providing personal data.

For optimised system performance, user friendliness and the provision of useful information on my services, the website provider automatically collects and stores so called server log files, which your browser automatically transmits to me. This information includes your anonymised IP address, browser typ and version, language settings, operating system, referrer URL, internet service provider, and the date and time of your visit.

The access data collected is stored only in aggregated form and therefore cannot be assigned to individual users. These data is used only for statistical evaluations for the purpose of operating, securing, and optimising the website (legitimate interest under Art 6 (1) (f) GDPR).

8. Cookies

This website uses “cookies” to improve usability, effectiveness, and security.

A “cookie” is a tiny text file that is downloaded by the web server on the hard drive of your computer via your browser and allows the website to recognise you as a user if a connection is made between the web server and your browser. Cookies help to establish the frequency of use and the number of users who visit the website. The content of the cookies used is confined to an identification number and does not allow to personally identify a user. Cookies are used to recognise users or to provide certain settings and functions.

This website uses two types of cookies:

• Session cookies: These are transient cookies stored in temporary memory, which are automatically erased when you close your browser.
• Permanent cookies: These cookies are stored on your device to improve user experience and recognition on your next visit.

Cookies may only be set without consent if they are technically necessary. Only cookies that directly serve the function of the website itself or the service offered via the website are technically necessary. Currently, only technically necessary cookies are set on my homepage.

You can configure your browser to notify you when cookies are set, to accept cookies only in specific cases, or to delete cookies automatically when the browser is closed. Disabling cookies may limit website functionality.

9. Notification of data breaches

I aim to identify data breaches early and – if necessary – report them immediately to you and the relevant supervisory authority, including a description of the data categories affected.

10. Data retention

Your data will only be stored for the period necessary to fulfil my contractual or legal obligations and to defend against any liability claims, but not longer than 30 years.
